House Bill 5522

Currently being considered to further mandate Combustible Dust safety, the Chemical Safety Board has suggested that a “Standard” for Combustible Dust Mitigation must be written and passed as law. The Bill funds staged development of the “Standard”, and staged enforcement as well. The Bill passed the House, and is before the Senate (the Senate may pass a “companion” bill of their own). The largest deterrents are: 1) OSHA has testified repeatedly that the NEP and associated standards are adequate, and that enforcement is now taking place without the need for additional lawmaking, and 2) the President of the United States has suggested this bill would be most likely vetoed, considering the lack of time for development of adequate financial impact studies.
